Terms of Sale — Dekko Green

1. Purpose

These Terms of Sale define the conditions under which Dekko provides its paid services, including the annual and monthly subscriptions.

2. Pricing

Dekko service prices are as follows: Freemium plan: free access to basic features (1 carbon footprint); Starter Annual subscription: 99 EUR excl. tax/year (118.80 EUR incl. tax) — all included; Starter Monthly subscription: 12 EUR excl. tax/month (14.40 EUR incl. tax) — all included. Prices are indicated in euros excluding tax and including tax. VAT applies at the rate in force on the billing date. Dekko reserves the right to modify its prices, with any change applying to new subscriptions or renewals.

3. Subscription

The Starter Annual subscription is taken out for a fixed period of twelve (12) months. Grace period: The Client has thirty (30) days from the subscription date to cancel and receive a full refund. After this period, the commitment is firm and irrevocable for the remaining annual period. The Client may choose not to renew at any time before the anniversary date. Non-renewal takes effect at the end of the current annual period. For the monthly subscription, cancellation takes effect at the end of the current month. No pro-rata refund will be made. Upon cancellation or non-renewal, the Client retains access to all features until the effective end date. The Client may export all data before this date.

4. Payment Methods

Payment is made exclusively by credit card via our secure payment provider Stripe. Accepted cards: Visa, Mastercard. Annual subscription payment is debited in full at subscription and on each anniversary date. Monthly subscription payment is debited automatically each month.

5. Right of Withdrawal

In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply to contracts for the supply of digital content not supplied on a tangible medium whose execution has begun with the consumer's agreement. During subscription, you will be asked to expressly acknowledge waiving your 14-day right of withdrawal once the service has been fully executed. However, Dekko offers a 30-day grace period for annual subscriptions, allowing a full refund upon simple request.

6. Refund

No refund is due in case of monthly subscription cancellation mid-month, non-renewal of an annual subscription, or annual subscription cancellation beyond the 30-day grace period. A full refund is provided in case of cancellation within the first 30 days of the annual subscription, a technical error attributable to Dekko, prolonged service unavailability exceeding 72 consecutive hours, or proven double billing.

7. Liability

Dekko undertakes to provide its services with diligence. Dekko's liability shall be limited to the total amount paid by the User in the 12 months preceding the damaging event.

8. Late Payment Penalties (B2B)

In case of late payment, late payment penalties will be applied at the rate of three times the legal interest rate. A fixed indemnity of 40 euros for recovery costs shall be due automatically. These provisions apply only to professional clients (B2B).

9. Applicable Law

These Terms of Sale are governed by French law. In case of dispute, the parties agree to seek an amicable solution prior to any legal action.

10. Mediation

In accordance with Articles L.612-1 et seq. of the French Consumer Code, in case of dispute, the consumer may use the mediation service free of charge. You may also use the European Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr.
